Things don’t seem to be going well for Apple and the law as yet another class action lawsuit was filed against the company. According to this latest class action lawsuit, a customer from Colorado is demanding $5 million for a defect in Apple Watch. The lawsuit claims that all the Apple Watches ever launched from the original Apple Watch till the latest Series 3 are suffering from the same defect. The lawsuit claims that this defect causes the Watches to “crack, shatter, or detach from the body of the Watch”.
The lawsuit goes on to claim that Apple is aware of the issue and refuses to acknowledge the issue. It adds that the defect occurs “through no fault of the wearer”, sometimes happening “just days or weeks after purchase” as reported by Patently Apple. The complaint pointed out that “Apple has actively concealed and failed to disclose the Defect to Plaintiff and Class members prior, to, at, or after the time of purchase”. If this turns out to be true then it is a serious oversight from Apple point of view especially considering that the ongoing class action lawsuits regarding the butterfly keyboards in the MacBook Pro.

This lawsuit comes weeks after it was revealed that Apple was aware of Apple iPhone 6 and 6 Plus Bent-gate. What makes the case stronger is the fact that the company has acknowledged two defects including swollen batteries and back covers detaching from the watch for Series 0 models while “extending warranties” for affected users by three years. The detaching of back cover from the watch was not limited to Apple Series 0 and extended to a number of Series 2 models.
This news comes right after Apple was granted a new patent for what appears to be a blood pressure measuring device that users will have to wear on their wrist. The wristband will be able to connect with other Apple devices to sync the readings. It is likely that the part where the patent states that this system will be “incorporated” in “a portable multi-function device” or to communicate with such device is implying to integration inside the Apple Watch or communication with the Apple Watch.
